Director Ordered to Pay a Fine for Overlooking Risk of Legionella

After finding him guilty of being unable to control the legionella menace in the cooling towers belonging to his company, the managing director of a Black Country organization has been asked to pay a sizable fine.

Although repeated alerts were issued from water treatment contractors, Ernest Jones who is the Managing Director of First Metal Finishers Ltd, located at Coseley, was found negligent of not setting up a management system to check the spread of legionella. Mr Jones of Rugeley, Staffordshire, admitted to the contravention of Section 37(1), by virtue of Section 3(1), of the Health and Safety at Work etc. Act, 1974.He was asked to pay costs of ₤1,000 and a fine amounting to ₤2,000.

The sequence of events, as it had unfolded, was narrated to the Dudley magistrates detailing how, in September 2008, inspectors had surveyed two cooling towers of First Metal Finishers Ltd. in Cannon Business Park to ascertain ways to check the transmission of legionella bacteria that was present in those towers. Although the towers were working to their fullest capacities at the time of the visit, the lack of a proper management system to check the transmission of legionella was obvious. It was also determined that there had been no proper arrangements for the last eight months for controlling the spread of legionella. The necessary monitoring or test checks too were not carried out.

Following this, a notice to stop the towers from working was immediately issued along with a notice for the improvement in the monitoring system. The shortcomings that were found in the investigation revealed how the company’s Managing Director, Ernest Jones, had disregarded the notices.

HSE inspector, Sarah Palfreyman felt that the danger was clearly visible and hence totally avoidable. The company had received quotes from two companies that dealt in water treatment, but had not taken action on any of them. It had also received a notification about the huge levels of bacteria present in the towers, which could prove hazardous. However, with the company doing nothing to stop the spread of the bacteria, the Dudley area as well as other places were afflicted and this became a major hazard for the residents of those areas.

BCC Fears Constant Employment Law Changes will Impede Economic Recovery

Even as the government increases its focus on family-centric employment policies, the British Chambers of Commerce (BCC) has called for some constancy in the legislative regulations applicable here. The ‘Think Fathers’ business case will later be improved and expanded and distributed through Business Link to promote family friendly-employment practices. The Conservatives have assured the public of flexible parental leave if they come to power.

Low Job Satisfaction May Hamper Market Recovery, Warns CIPD

An alarmingly low job satisfaction rate among employees across the UK spells trouble for the recovery of the economy even as the effects of the recession are slowly beginning to wear off. This was revealed in the latest quarterly Employee Outlook survey brought out by the Chartered Institute of Personnel and Development (CIPD).

The CIPD undertakes surveys on employee issues, attitudes and ideas from time to time and compiles the Employee Outlook report every quarter. Last spring the survey revealed that 38 percent of the employees felt they were under heavy stress and pressure at work on a regular basis. The latest poll shows an increase of nearly 4 percent in this category, taking of the percentage of stressed workers to 42.

An increase in bullying by line managers and in the number of conflicts at work has also been reported in the survey. These are attributed to the lowered confidence levels and stress of workers in the time of economic recession.

The survey took into consideration the responses of over 2000 employees across the country to come up with its conclusions. The CIPD also measured the net employee job satisfaction. The score has dipped from +46 to +37 since spring this year, displaying an alarming downward shift in this area.

Claire McCartney, resourcing and talent planning adviser at CIPD, has warned that this could be a dangerous trend. She pointed out that sagging job satisfaction could mean lower productivity and low efficiency of workers. She said these factors could significantly hamper any recovery in the markets even as the adverse effects of the recession are beginning to wear off.

McCartney advises employers to make sure that employees are deployed in jobs that suit their temperament and skills. This will give them a sense of doing something worthwhile, she believes. She warns that the danger of talent drain looms large even as the need for reliable and experienced workers grows bigger to aid businesses during the market recovery process.

Professor Khan was of the opinion that ergonomic solutions will not only prevent back problems but also help the company save costs in the long run. He called upon managers and workers, especially employees with back-related disorders, to come together and improve the workplace ergonomically.
